General Terms and Conditions of Business

1. Scope of the GTC and conclusion of contract

1.1 These General Terms and Conditions of Business (GTC) apply to purchase contracts with private customers and companies that are concluded via the provider's website.

1.2 The order shall be confirmed by the provider. The contract is concluded as soon as the buyer receives this confirmation. If the buyer does not receive a confirmation in a timely manner, the order shall be considered to have been rejected and the buyer shall be entitled to enter into a contract with another supplier.

2. Prices and special offers

2.1 Prices are stated in Swiss francs (CHF). Prices include value added tax as well as prepaid recycling fees and processing costs. Shipment costs are charged separately.

2.2 The provider reserves the right to change the prices at any time. The prices published on the website on the order date apply for customers.

2.3 The conditions for special offers and discounts can be found in the relevant information sections.

3. Terms of delivery

3.1 Delivery shall be made as soon as possible. The customer shall be informed in a timely manner if the delivery has to be delayed. If no information is provided, the customer shall be entitled to waive the delivery.

4. Liability and warranties

4.1 For a period of 12 months, the provider warrants that the goods possess the assured qualities, have no defects that affect their value or suitability for their intended use, and meet the agreed criteria and specifications.

4.2 The buyer has to check the delivered goods as soon as possible and immediately notify any defects. The contact details for the competent customer service can be found at www.bellshop.ch. Hidden defects can also be notified after the goods have been put in service or used. Payments made do not qualify as a waiver of the notification of defects.

4.3 If there is a defect, the buyer can choose to demand rectification of the defect free of charge, to apply a reduction in price to compensate for the reduced value, to withdraw from the contract or to demand delivery of a replacement product. The buyer's right to claim damages is reserved at all times.

6. Liability for online connections

6.1 The provider undertakes to ensure that the systems, programs, etc., it owns and can control are secured in accordance with the latest technological standards and to comply with the regulations on data privacy.

6.2 Customers are responsible for the security of the systems, programs and data that fall within their sphere of influence. In order to protect their interests, customers should refrain from disclosing their passwords and user names to third parties.

6.3 The provider accepts no liability for faults and malfunctions for which it is not responsible, in particular not for security defects and downtime by third-party companies with which it cooperates or on whom it depends.

6.4 The provider is also not liable for force majeure, improper operation and disregard of the risks by the customer or a third party, excessive use, unsuitable accessories used by the customer or a third party, extreme environmental impact, intervention by the customer or defects introduced by third parties (viruses, worms, etc.) that occur in spite of the implementation of all the required security measures.

7. Applicable law and place of jurisdiction

7.1 These GTC are subject to Swiss law, in particular the provisions of the Swiss Code of Obligations.

7.2 The court at the domicile or registered office of one of the parties has jurisdiction over actions filed by a customer. The court at the domicile of the defendant has jurisdiction over actions filed by the provider.
